PETITION AGAINST THE STATE GOVERNMENT - the Respondents:

Highlights of the Judgement:

........  respondents 1,2 and 3 (Respondent 1-The State of Tamil Nadu,  rep by its Principal Secretary to Government, Higher Education (E2) Department,  Respondent  2 -The Director of Collegiate Education, Respondent 3 -The Regional Joint Director of Collegiate Education) to release teaching grant towards the salaries of teaching and non teaching staff directly to those staff by authorizing the third respondent, i.e., Regional Joint Director of Collegiate Education, Madurai Region until the controversy between the writ petitioners and the other contesting respondent and the group backing him are resolved in the manner known to law.

      The respondents 1 to 3 are hereby directed to disburse the salaries due to teaching and non teaching staff and credit it in the respective bank accounts maintained by those teaching and non teaching staff within a period of four weeks from the date of receipt of copy of this order. By this order the intention of this court is to protect the teachers from falling into an acute economic hardship which will no way prejudice either of contending parties.

       With reference to the show cause notice, this court is not giving any finding nor concluding it one way or other. It is for the respondent State to evolve means and measures to control such minority colleges by making reasonable regulations which will be intra vires of Article 30(1) of the Constitution.
